1. Introduction

 

As part of Z Talent Solutions Sdn. Bhd. and its related companies’ (“Z Talent Solutions”, “we”, “us”, “our”, or “ours”) commitment to act with integrity and respect others, we protect the personal data of our stakeholders, including customers, shareholders, partners, employees, suppliers and other individuals who trust us with information (“you”, “your” or “yours”).

"Personal data" includes information in respect of commercial transactions which identifies or locates an individual, or is capable of doing so. 

To be a trusted business partner, Z Talent Solutions continually strives to protect personal data in accordance with applicable laws and regulations, namely the data protection principles under the Personal Data Protection Act 2010 (the “PDPA” or “Act”). To that end, this Policy guides how Z Talent Solutions collects, uses, stores, transfers and secures personal data and to ensure the rights of the data subjects are protected.

In this Policy, Z Talent Solutions seeks to inform data subjects of the purpose for which their personal data is collected and processed and the data subject’s right to access or refuse to provide such personal data.

2.1  Everyone has rights with regard to how their personal information is handled. During the course of its activities, Z Talent Solutions may collect, store and process personal information about staff, customers, suppliers, vendors, and we recognise the need to treat this data in an appropriate and lawful manner. Z Talent Solutions is committed to complying with its obligations in this regard in respect of all personal data it handles.

2.2  The types of information that Z Talent Solutions may be required to handle include details of current, past and prospective partners, suppliers, customers, and others that we communicate with. The information, which may be held on paper or on a computer or other media, is subject to certain legal safeguards specified in the Act and other regulations. The Act imposes restrictions on how Z Talent Solutions may collect and process that data.

 

3. Purpose and Scope of the Policy

 

3.1  This Policy sets out Z Talent Solution’s rules on data protection and the legal conditions that must be satisfied in relation to the collecting, obtaining, handling, processing, storage, transportation and destruction of your personal and sensitive information.

3.2  To serve you better, you are aware and agreeable that we may share information you give us with our partners, suppliers, customers and/or employees when you:

3.2.1    register with our website;
3.2.2    submit any physical forms directly to us or to any of our partners, suppliers, customers and/or employees;
3.2.3    submit any electronic forms available in this website, including subscription forms; and
3.2.4    send an electronic email that includes your personal data.

4. Definition of Data Protection Terms 
 

4.1  Data is information which is stored electronically, on a computer, or in certain paper-based filing systems. 

4.2  Data subjects for the purpose of this Policy include you and all other living individuals about whom Z Talent Solutions holds personal data.

4.3  Personal data means data relating to a living individual who can be identified from that data (or from that data and other information that is in, or is likely to come into, the possession of the data controller). Personal data can be factual (such as a name, address or date of birth) or it can be an opinion (such as your field of interest for study).

4.4  Data controllers are the individual or organisations who control and are responsible for the keeping and use of data.

4.5  Data users include employees, partners, suppliers and/or customers whose work involves using personal data. Data users have a duty to protect the information they handle by following Z Talent Solution’s data protection and security policies at all times.

4.6  Processing means performing any operation or set of operations on data, including:

4.6.1    obtaining, recording or keeping data;
4.6.2    collecting, organising, storing, altering or adapting the data;
4.6.3    retrieving, consulting or using the data;
4.6.4    disclosing the information or data by transmitting, disseminating or otherwise making it available; and
4.6.5    aligning, combining, blocking, erasing or destroying the data.

5. Use of Your Personal Data 

5.1  Personal data is used to provide products and services and to inform about products and services offered by Z Talent Solutions to you and may include:

   5.1.1   profiling and determining service and preferences;
   5.1.2   for the purposes of technical administration of Z Talent Solutions website; 
   5.1.3   statistical analysis; 

   5.1.4   developing new products and services;
   5.1.5   registration for services upon your request; 
   5.1.6   providing goods and services to you, including The Zeal Journal;
   5.1.7   payment processing for your purchases; 
   5.1.8   protection against or identifying possible fraudulent transactions;
   5.1.9   developing and providing advertising adapted to our customers;
   5.1.10 finance and marketing operations and/or as required by the terms and conditions of business and                      other business administration purposes including credit monitoring and control purposes;
   5.1.11 to meet regulatory and legal requirements;

   5.1.12 for risk management; and/or
   5.1.13 for all other purposes incidental and associated with the above.

6. Notice and Choice Principle 

Z Talent Solutions is aware that you, as the data subject, have the right to make a choice not to provide your personal data and may revoke your consent to the collection and processing of your personal data. In this regard, Z Talent Solutions is aware that certain services it provides and the continuation thereof may require the processing of such data. Failure to process such data will result in discontinuation of such services.

7. Disclosure Principle 

Your personal data should only be collected to the extent that it is required for any of the specific purposes stated in 5.1 which should be duly notified to the data subject. Personal Data will be kept confidential but may be disclosed to the following categories of parties for the purposes set out:

 

• to any Z Talent Solutions companies in and outside of Malaysia; 

• to our advisers, including consultants, advocates and solicitors for purposes of determining our rights and enforcing any agreement with data subjects; 

• to any of our partners, suppliers and/or customers, which may include agents, universities, education consultants and service provider, to whom we may have outsourced services to, subject always that such parties acknowledge the confidentiality and rights of the data user and to comply with the provisions of the Act;

• to regulatory authorities or notified bodies including bodies providing quality certification of our products upon their request; and

• to such other parties as may be permitted under Malaysian law.

8. Retention Principle 

8.1  Your personal data shall be stored either in hard copies in Z Talent Solutions offices or stored in servers located in or outside Malaysia and operated by Z Talent Solutions or its service providers in or outside Malaysia. Any personal data supplied to Z Talent Solutions will be retained by Z Talent Solutions as long as necessary for the fulfilment of the purposes stated in 5.1 above or to protect Z Talent Solutions' interests.

8.2   Z Talent Solutions has put in place technology and standards to protect stored and transmitted personal information you give us. This includes encryption software and strict security standards. However, while we are committed to protecting your personal data, we do not guarantee unauthorised or accidental access to such data. 

8.3  It shall be our duty as a data user to take all reasonable steps to ensure that all personal data is stored properly, and destroyed or permanently deleted if it is no longer required for the purpose for which it was to be processed.

9. Data Integrity Principle 

Your personal data must be accurate, complete, not misleading and up to date upon submission. Information which is incorrect or misleading is not accurate and steps should be taken to check the accuracy of any personal data at the point of submission or collection.

10. Access Principle

10.1  You may request access to and correct your personal data held by Z Talent Solutions. If you wish to obtain a copy of any of your personal data; if you believe that the personal data relating to you which Z Talent Solutions collect and maintain is incorrect; or if you believe that the personal data held by Z Talent Solutions was used beyond the scope of the purposes described in 5.1 or was acquired by fraudulent or unlawful means or provided to a third party without your prior consent, you may write to Z Talent Solutions at the addresses below.

10.2  A request for access or correction to, or deletion of personal data or for information regarding policies and practices and kinds of personal data held by Z Talent Solutions must be in writing and sent to Z Talent Solutions via email address or postal mail to the following:

11. Transferring Data Outside Malaysia

As Z Talent Solutions operates internationally, it may be necessary in the course of business that Z Talent Solutions has to transfer your personal data within the organisation and/or to our partners, agents, suppliers or customers located in countries such as the United Kingdom, Italy, Spain, Thailand and Singapore that is outside Malaysia, which do not necessarily have comparable data protection laws to Malaysia. The transfer of such data is necessary for the purposes set out in Clause 5.1. When this is required, Z Talent Solutions will take steps to ensure that the data has the same level of protection as it does inside of Malaysia.
